AGREEMENT, WAIVER AND RELEASE
I hereby waive, release, acquit and forever discharge Gold Star Teen Adventures INC., its employees, agents, servants, officers, directors, and representatives (in their official and individual capacities) from any and all liability whatsoever for all damages, losses, or injuries (including death), mental anguish or emotional distress to person and/or property, including but not limited to any claims, demands, actions, causes or action, damages, costs, expenses (including hospital and medical expenses) and attorney fees, which arise out of, during, or in connection with my attendance at, participation in, or arising out of one, some or all of the following Activity or Event,
Gold Star Teen Adventures Junior Warrior Weekend
Gold Star Teen Adventures White Tail Deer Hunt
including travel to and from the Activity or Event. This release is intended to discharge in advance Gold Star its employees, agents, servants, officers, directors, and representatives from any and all liability arising out of or connected in any way with my participation in Activity or Event offered by Gold Star even if that liability arises out of negligence or carelessness on the part of those parties. It is understood that activities such as the ones I will be participating in involve an element of risk and danger of accidents and knowing those risks, I hereby assume those risks. It is further agreed that this waiver, release and assumption of risk is to be binding on my heirs and assigns. I agree to indemnify and to hold harmless, Gold Star its employees, agents, servants, officers, directors, and representatives from any loss, liability, damage, cost or expense which they may incur as the result of my death or any injury or property damage that I may sustain while participating in the Activity or Event.
I represent and warrant that I will be covered throughout the Activity or Event by a policy of comprehensive health and accident insurance which provides coverage in amounts I deem adequate for injuries which I may sustain as part of my participation in the Activity or Event. I hereby release and discharge Gold Star of all responsibility and liability for any injuries, illnesses, medical bills, charges, co-pays, deductibles or similar expenses, whether covered by health insurance or not, that I may incur while participating in Gold Star Activities or Events. I hereby represent that I do not have any physical or mental condition which may require special medical attention or accommodation during the Activity or Event. I certify that I am physically fit, have sufficiently prepared or trained for participation in the Activity or Event, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in the Activity or Event.
Gold Star reserves the right to decline to accept or retain me in the Activity or Event at any time should my actions or general behavior be deemed in the sole discretion of Gold Star to impede the operation of the Activity or welfare of any person.
I understand that by participating I grant permission to Gold Star Teen Adventures INC., its representatives, affiliates and employees to use any photographs of myself or of my property. I authorize Gold Star Teen Adventures INC., its assignees and transferees permission to use and publish the same in print and/or electronically in but not limited to advertisements, publications and websites.
CONSENT OF PARENT/GUARDIAN (If participant is a minor)
I am the parent or legal guardian of the Participant listed above. I hereby consent that the participant may participate in activities at this, or any other Gold Star Activity or Event and I hereby execute the Agreement, Waiver and Release on his/her behalf. I hereby affirmatively state that the said Participant is physically able to participate in said activity. I hereby agree to indemnify and hold the persons and entities mentioned above free and harmless from any loss, liability, damage, cost or expense that they may incur as result of the death or any injury or property damage that said Participant may sustain while participating in activities at any Gold Star Activity or Event.
I HAVE CAREFULLY READ THIS AGREEMENT, WAIVER AND RELEASE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND GOLD STAR TEEN ADVENTURES AND THAT I HAVE SIGNED IT KNOWINGLY AND VOLUNTARILY. THIS RELEASE SHALL BE BINDING ON THE HEIRS, SUCCESSORS, ASSIGNS, AND PERSONAL REPRESENTATIVE OF ME.
