This agreement (the "Agreement") is between Mr. and Mrs. _______ (referred to in this Agreement as "Parents") and the H.F. Epstein Hebrew Academy ("EHA"). This Agreement is for the following student(s) to attend EHA for the 2018-2019 school year:

STUDENT(S) WILL ONLY BE ADMITTED TO CLASS ON THE FIRST DAY OF SCHOOL IF ALL CUSTODIAL PARENTS HAVE SIGNED THIS AGREEMENT AND MET OR AGREED TO MEET ALL FINANCIAL OBLIGATIONS BELOW. EHA SHALL HAVE COMPLETE DISCRETION TO DECIDE WHETHER TO OFFER RE-ENROLLMENT TO A STUDENT FROM ONE YEAR TO THE NEXT, AND SHALL HAVE COMPLETE DISCRETION TO DETERMINE IN WHICH GRADE AND/OR CLASSES A STUDENT WILL BE ENROLLED.

I. Tuition/Other Fees

The above tuition does not include charges for after school programs, musical instruments, early care, transportation, re-enrollment, or new student registration. Parents will be billed separately and periodically during the year for other costs, such as those listed above.

 *These are suggested minimum amounts and are deductible to the extent allowed by law. If Parents have any questions regarding the deductibility of such amounts, please consult with your own tax advisor.

II. Admissions Policy

 
A. A non-refundable deposit of $500 must accompany the tuition contract. This deposit will be applied towards tuition.  Tuition payments must be received by the School on or before each due date.
 
B.  In order for a student to begin classes on the first day of school, families must meet the following criteria:
  1. You are current with all past balances or made satisfactory arrangements and received written approval from the Chair of the EHA Finance Committee for outstanding balances.
  2. Complete this Agreement and the SMART TUITION agreement
  3. Enclose a $250 Epstein Hebrew Academy banquet check (post-dated to 11/15/18).
  4. Enclose a $350 scrip deposit check (post-dated to 08/15/19).

C. Parents agree that if payment of tuition and fees is not made in accordance this Agreement, EHA shall have the right to:

  1. Refuse to admit the student to class.
  2. Withhold the transcript or other record of grades awarded or courses completed until all financial obligations of the parents due at that particular time are satisfied, to the extent permitted by applicable law.
  3. Assess a $25 fee for non-sufficient funds for payments.
  4. Assess a $50 penalty for late payment should the payment be received after the 5th of the month following the month when the payment is due, and further assess a $50 penalty on the 5th of each following month that such payment has not been made.
  5. Refer the matter to a collection agency.

D. EHA believes that a positive and constructive working relationship between the school and parents is essential to the fulfillment of EHA’s mission. Thus, it is understood that each student is required to meet the academic standards of EHA and to abide by all rules and policies established for EHA in order to retain his or her place as a student at EHA. The rules and policies currently in effect can be found in the Parent Handbook, a copy of which will be made available upon request. EHA reserves the right to amend, modify, supplement or change the Parent Handbook. EHA reserves the right to dismiss or suspend any student who does not respect its standards or provide reasonable cooperation in the educational process, or whose conduct is considered by the Head of the School’s being detrimental to the best interest of EHA. Parents agree to provide full cooperation with EHA in matters concerning student-school relationships and to refrain from any action, which is disruptive of discipline or destructive of the authority properly exercised by the representatives of EHA. Parents agree to accept the rules and regulations adopted by EHA.

E. Parents agree that the student may participate in all school activities, including athletics, except that parents must approve any trips away from the campus in advance. EHA, its agents, employees, independent contractors, trustees, officers, directors, volunteers or other representatives, shall not be liable for any claims, demands, injuries, damages, actions or causes of action whatsoever to Parents, the student(s) or Parents’ property or the student’s property arising out of, or connected with student(s) being at EHA, to the extent any of the foregoing arise out of negligence of EHA, its agents, employees, independent contractors, trustees, officers, directors, volunteers or other representatives. In case of accident or serious illness, Parents request EHA contact Parents. If EHA is unable to contact Parents’ physician or if the circumstances indicate immediate action is required, EHA may make whatever arrangements in its judgment are required. EHA encourages Parents to carry sufficient insurance to cover situations involving injuries to their children.

F. Parents agree to pay, to the extent permitted by law, EHA's expenses of enforcement and collection of the tuition, fees and related expenses, including, without limitation, attorneys’ fees and costs.

III. Scrip Program

For EHA’s scrip program, parents are required to submit a $350 post-dated check dated August 15, 2019. Parents need only make one script deposit no matter how many students they have enrolled at EHA. Parents are responsible for ensuring that EHA receive at least $350 as result of the purchase/sale of scrip. Scrip for various stores (including "generic" scrip that can be used at Simon Kohn’s and Long Acres and “non-generic” scrip for a variety of vendors; including, Sam’s/Wal-Mart, Target and Starbucks) may be ordered for purchase at EHA. Parents will be credited such amount as EHA earns from the purchase/sale of scrip. For more information about the scrip program, please contact EHA’s Business Office.

IV. Refund Policy

In the event that a student is withdrawn from EHA at any time after this Agreement has been signed and returned to EHA, whether for absence, withdrawal, or dismissal the parent(s) shall be responsible for tuition and fees as follows.

Provided, however, that in the event the student and the student’s family unexpectedly move their residence from the St. Louis metropolitan area and were unable to anticipate such move prior to August 1, 2017, then Parent must notify EHA in writing of the relocation circumstances as soon as possible, and EHA will prorate the tuition (based on full or partial months of school attended) and provide an appropriate refund to Parents.

It is agreed and understood that, in light of the commitments which are made by EHA based on this signed Agreement, and in light of the fact that the actual cost to EHA of the withdrawal of a student is difficult to ascertain, the amount of the obligation for tuition and fees indicated above reflects a reasonable estimate of the cost to EHA arising from the withdrawal or dismissal of a student.

V. Tuition Payment Plan

If Parents pay the full tuition by cash or check prior to June 16, 2018, then Parents may deduct a 3% early payment discount from the amount of tuition for such student(s). Parents are required to sign an agreement with SMART TUITION authorizing SMART TUITION to automatically withdraw funds sufficient to make tuition payments from the Parent’s bank account on a periodic basis. A copy of the SMART TUITION agreement is attached. Parents can select that funds be withdrawn on the 1st, 3rd, 10th, 15th, 20th, 30th or 31st of each month and have choices for payment plans (virtually any combination of months - monthly, quarterly, semi-annually, etc. as well as which months they want it taken (non-monthly). SMART TUITION will then electronically transfer the funds to EHA. If there are insufficient funds in Parents’ bank account, SMART TUITION will notify EHA and Parents will be subjected to any and all penalties provided for under this Agreement.

VI. Rabbinic Mediation and Arbitration

In keeping with the strong preference under Jewish law for resolving disputes among Jews in rabbinic courts, in the event that a dispute arises out of this Agreement, Parents agree to waive the right of access to any state or federal court and to litigate the dispute by submitting it to mediation and/or binding rabbinic arbitration under the auspices of the Chicago Rabbinical Council. The Chicago Rabbinical Council will appoint one or more Rabbis to mediate the dispute between Parents and EHA. If the parties are unable to resolve the dispute through mediation, then the parties must submit to the dispute to binding arbitration and the Chicago Rabbinical Council will select one or more Rabbis to act as arbitrators. The decision of such rabbinic arbitrator(s) shall be final and binding upon the parties, and may be enforced in a secular court of law.

VII. Agreement

Parents agree to the above payment terms and conditions and to abide by the SMART TUITION agreement. In the event that Parents received a tuition reduction (scholarship), Parents agree to notify the EHA Head of School and Scholarship Committee in the event of any increase in the Parents’ income at any time during the applicable school year and that the financial assistance may be reduced as a result of such increase in income. The newly adjusted tuition amount will replace the amount of this Agreement. Failure to notify the Scholarship Committee of any such increase in income may result in the loss of financial assistance.

Furthermore, the financial assistance provided by EHA to be applied toward tuition is given on the specific condition that all tuition and other payments to be made by Parents are made in a timely manner. In the event Parents are delinquent in any such payments, EHA reserves the right to withdraw such financial assistance.

Parents understand(s) that in signing this Agreement for the coming academic year, Parents agree to accept the rules concerning payment of fees as outlined above in that this Agreement represents a binding agreement for EHA to reserve a position exclusively for the student(s) named above and provide educational services for the 2018-2019 academic year, and that Parents are responsible for the tuition and other fees this Agreement entails.

By signing this Agreement and enrolling one or more students at EHA, Parents agree to release and hold harmless EHA, its agents, employees, independent contractors, trustees, officers, directors, volunteers or other representatives, for or against any claims, demands, actions or causes of action (to the extent any of the foregoing arise out of negligence of EHA, its agents, employees, independent contractors, trustees, officers, directors, volunteers or other representatives) alleging harm to Parents, a student or Parents’ property or property of a student, or for any claims based on allegations of damage caused by Parents or Parents’ child(ren), arising out of, or in any way related to, Parents’ child(ren)’s enrollment at EHA. In making this release and hold harmless agreement, Parents recognize that there are many risks, known and unknown, associated with attending EHA and participating in activities at EHA. Parents therefore make this release knowingly, voluntarily, and with the full understanding that enrolling Parent’s child(ren) at EHA is a voluntary act and there are other educational alternatives for Parent’s child(ren).

The undersigned Parent(s), as the person(s) having primary care and custody and being financially responsible for the student named above, hereby accept and agree to the terms of enrollment as set forth in this Agreement.

By signing below, the undersigned Parents agree that they shall be jointly and severally responsible for all tuitions and fees. THIS CONTRACT CONTAINS A BINDING ARBITRATION PROVISION WHICH MAY BE ENFORCED BY THE PARTIES.
